Former President Donald Trump has taken strong legal action against his former lawyer, Michael Cohen, who testified against Trump before the Manhattan grand jury and implicated him in criminal charges of falsifying business records related to adult film star Stormy Daniels. Trump has filed a lawsuit against Cohen seeking $500 million in damages for violating attorney-client privilege and spreading lies about him with malicious intent.
Conservative legal expert Alan Dershowitz praised Trump’s move during a panel discussion on Fox News. He argued that it is a good move to go after Cohen as lawyers should not be violating lawyer-client privilege. Moreover, if Trump survives a motion to dismiss, he will be able to get a discovery and find out things that the government would not turn over to him in a criminal trial.
Gregg Jarrett, another panelist, also supported Trump’s lawsuit against Cohen. He argued that it is a legitimate suit that centers around the many lies of Michael Cohen. This is a guy who lied to the IRS, lied to U.S. banks, lied to Congress, and went to prison for it. On top of that, Cohen committed theft, and unjust enrichment by defrauding Trump over a phony business venture and pocketing an exorbitant amount of money over something that did not exist. Cohen also breached his fiduciary duty, which is pretty darn clear, and breached his contract.
Jarrett further argued that it’s bad enough that prosecutors called Cohen a greedy liar and the judge who sentenced him said he committed a veritable smorgasbord of fraudulent crimes and deceit. He said that it’s hard to tell the jury to believe a guy like that who has told so many lies that you would need a calculator to keep track of it.
Trump’s lawsuit alleges that Cohen violated attorney-client privilege by sharing confidential information and spreading lies about him with malicious intent. Trump has suffered vast reputational harm as a direct result of Cohen’s breaches. Cohen derived a significant benefit to Trump’s detriment and at his expense, as a direct result of his breach of fiduciary duty.
The lawsuit filed by Trump attorney Alejandro Brito in U.S. District Court for the Southern District of Florida is seeking over $500 million in “actual, compensatory, incidental, and punitive damages” from Cohen and any profits that he made from his podcast and books.
This lawsuit is an important step for Trump to clear his name from the false charges that have been brought against him by Democrats. Cohen’s lies have caused significant reputational harm to Trump, and he deserves to be compensated for the damage that has been done to him.
Democrats have been using Cohen’s false testimony to try to impeach Trump and tarnish his reputation. However, this lawsuit shows that Trump is not going to sit idly by and let them get away with their lies.
